New Incorporated Societies Act 2022

After 110 years the Incorporated Societies Act 1908 has been updated and replaced by the new Incorporated Societies Act 2022. The 2022 Act came into effect from 5 October 2023, so all new incorporated societies formed after this date will do so under the new Act.  

All existing Societies will have a grace period of two and a half years in which to re-register; the grace period ends April 2026.  It is important to note that re-registration is not an automatic process.  Existing Societies must re-apply and submit refreshed Rules or a Constitution which complies with the 2022 Act.

In addition to the requirement to re-register and provision of new governance and administration guidance, the 2022 Act puts in place more severe penalties on infringements.
